1. Acceptance of Terms

By accessing or using the Swake platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

Swake provides a feedback infrastructure platform for mobile applications, including SDKs, a web dashboard, analytics, surveys, and related developer tools.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account.

4. Acceptable Use

You agree not to use Swake to:

• Violate any applicable laws or regulations
• Collect data without appropriate user consent
• Transmit spam, malware, or harmful content
• Attempt to gain unauthorised access to our systems
• Interfere with the integrity or performance of our services
• Resell or sublicense our services without written permission

5. Payment and Billing

Paid plans are billed monthly or annually. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days’ notice. Failure to pay may result in suspension or termination of your account.

6. Intellectual Property

Swake and its licensors own all intellectual property rights in the platform. Your use of the service does not grant you ownership of any content or intellectual property. You retain ownership of all data you submit through the platform.

7. Data Processing

By using Swake, you acknowledge that feedback data submitted by your end users will be processed on our infrastructure. You are responsible for ensuring you have appropriate legal bases for collecting and processing this data, and for informing your users accordingly.

8. Limitation of Liability

To the maximum extent permitted by law, Swake shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim shall not exceed the amounts paid by you to Swake in the 12 months preceding the claim.

9. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the service will cease and your data will be deleted within 90 days, except where retention is required by law.

10. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the service after changes constitutes acceptance of the new terms.
